DNLL Election Procedures

 

I. ELECTION OF OFFICERS

SCHEDULING OF ELECTIONS

Elections of Officers shall occur at the October league meeting.

NOMINATIONS

Nominations for President, Vice-President, Treasurer, Secretary, Safety Officer and Player-Agent shall be made at the September league meeting with elections occurring at the October league meeting. Any general member, in good standing, as defined in the By-Laws, is eligible to nominate a candidate for these positions. In the event that a candidate is nominated for more than one position that candidate must elect the one position that he seeks for a candidate’s name may only appear on the ballot with respect to one position. An individual may only be a candidate for one position with respect to a given election.

BALLOTS

Printing

The Secretary shall print ballots which shall state the name of each candidate and the position that the candidate is seeking.

Distribution

The Secretary shall determine those individuals who are eligible to vote in any given election. The Secretary shall control the distribution and collection of ballots. In order to be eligible to vote, one must be present. Voting by proxy is prohibited.

Alternate to Secretary

In the event that the Secretary is a candidate for any contested position in the election then a person who is not a candidate for a contested position shall assume the election responsibilities of the Secretary according to the following succession:

  • Player Agent
  • President
  • Vice President
  • Treasurer
  • Major Division Director
  • AAA Division Director
  • Minor AA Division Director
  • Minor A Division Director
  • T Ball Division Director
  • Manager’s Representative

One is not eligible to assume these election responsibilities if he or she is a candidate for an opposed position in the election.

Statements by Candidates

Each candidate may, but is not required, to address the membership prior to the balloting. Any member shall be allowed to present questions to any candidate prior to the balloting.

Opening

No ballots are to be opened until all ballots have been received at which time the Secretary shall retire to a private location to open the ballots. Each candidate may appoint a representative, other than himself, to witness the Secretary open and tally the ballots.

Announcing Results

The Secretary shall announce the results of the election forthwith. In the event that the victor has obtained a margin of victory greater than five votes then the Secretary shall simply announce the name of the victor. Otherwise, the Secretary shall announce the name of each candidate and the number of votes that he/she received.

Tie

In the event of a tie, a second vote shall be taken forthwith. In the event of a second tie, the election for that position shall be rescheduled to occur at the next league meeting.

PROTEST

Any candidate may protest the results of any election by mailing a written protest to the President. The written protest must be post marked within seven (7) days following the election.

Upon receipt of a protest, the President shall schedule a meeting of the Board of Directors to occur within twenty-one (21) days of the date of election. Each candidate for the position under protest shall be invited to the meeting of the Board of Directors and shall be afforded an opportunity to address the Board of Directors.

The Board of Directors shall, by majority vote, either:

  • Affirm the results of the election;
  • or Reject the results of the election in which event another Election shall occur at the next scheduled league meeting.

The Board of Directors may only reject the results of the election on the Following grounds:

  • A violation of the election procedure;
  • or Fraud in the election process.

TERM OF OFFICE

Commencement of Term

Once one is elected to the Board of Directors, his or her term commences 10 days following the date of election provided that a protest has not been made concerning his or her position.

In the event of a protest, one’s term begins immediately upon the Board of Director’s act of affirming the results of the election.

Termination of Term

An individual’s term as a member of the Board of Director’s expires once that individual either resigns or is replaced in his position at the time when his or her replacement commences his or her term. 

Members of Board of Directors Eligible to Vote at Time of Protest

The members of the Board of Directors who are eligible to participate in a protest decision is to be determined based upon reference to Paragraphs E1 and E2 above.

Only those members whose terms are current at the time of the protest may participate in a protest decision. Furthermore, any current member of the Board of Directors who is a candidate for a protested position may not participate in a protest decision relative to that position.

II. ELECTION OF OTHER MEMBERS OF BOARD OF DIRECTORS

Scheduling of Election

Election of members of the Board of Directors, other than officers, shall occur at the November league meeting with the exception of Managers’ Representative which election shall occur at the April League meeting. All other elections relative to vacant positions shall occur at a regularly scheduled league meeting and shall be scheduled by the President and announced to the general membership at least one month prior to the election.

Nominee

General members may volunteer or suggest to the officers of the league other members for the remaining Board of Directors’ positions at the October league meeting.

The Officers of the league only, at the November league meeting, shall recommend individuals to serve on the Board of Directors. The members in good standing in attendance at the November meeting shall then vote to confirm the nominees. Any nominees that receive at least 50% of the vote of the members in good standing in attendance shall be deemed confirmed. In the event that any Board of Director position remains vacant following the November meeting or becomes vacant due to resignation, then those vacant positions may be filled in the same manner described above by any member in good standing from the league membership at any subsequent meeting. The President may appoint a temporary member of the Board of Directors for a period of no longer than 30 days. This temporary member shall not have voting privileges until voted in by the general membership.

Ballots

Ballots are not necessary for the election of the members of the Board of Directors other than Officers. Rather, it shall be the responsibility of the Secretary, by way of hand vote, to count votes in order to determine whether a nominating candidate receives at least 50% of the vote of the members in good standing in attendance.

Protest

Any candidate who is nominated for a position on the Board of Directors but who does not receive at least 50% of the vote of the members in good standing may protest the result of the vote, but must do so during the course of the league meeting when the voting occurred. If a quorum of the Board of Directors is present, the protest shall be decided forthwith. If a quorum is not present then the President shall schedule a meeting of the Board of Directors to occur as soon as possible. The protesting candidate shall be invited to the protesting meeting of the Board of Directors and shall have an opportunity to address the members of the Board of Directors.

The Board of Directors shall, by majority vote, either:

  • Affirm the results of the election;
  • or Reject the results of the election in which event another election shall occur at the next scheduled league meeting.

The Board of Directors may only reject the results of the election on the Following grounds:

  1. violation of the election procedure;
  2. or Fraud in the election process.
